Specific Terms & Conditions - Agoda Special Offers
  1. Agoda provides a user (“you”) of Agoda’s websites and/or mobile applications (“Agoda Platform”) with the option to make a booking for accommodation and certain added services, access, or benefits provided by or via the third-party accommodation provider, which may also include without limitation tours or activities (“Special Booking”).

  2. By making, or making use of, any Special Booking, you acknowledge and accept these Special Terms & Conditions (“ST&Cs”).

  3. You understand and agree that that you are transacting with or via the third-party accommodation provider with which you made the Special Booking, and that Agoda is not the provider of accommodation or any additional services, access, or benefits, including but not limited to tours or activities, within the scope of any Special Booking (“Additional Services”). Agoda does not guarantee, and has no control over, the nature, accuracy and/or safety of Additional Services relating to any Special Booking, including without limitation the truth or validity of any listing or other content provided by or via any accommodation provider or other third party on the Agoda Platform.

  4. You acknowledge that Agoda reserves, to the maximum extent permitted by law, all rights to remove any Additional Services and/or cancel Special Bookings should Agoda determine, at its sole discretion, that an Additional Service violates any applicable law or any term under Agoda’s community standards or internal policies.

  5. To the maximum extent permitted by law, in no event will Agoda or any of Agoda’s holding companies, subsidiaries, affiliates, officers, directors, and employees (“Agoda’s Affiliates”) be liable for any claims, losses, damages, costs, or other harm relating to the Agoda Platform, your use of the Agoda Platform, these ST&Cs, any Special Booking, or any transaction, accommodation, or Additional Services relating thereto. You acknowledge and agree that you will not hold, or seek to hold, Agoda or any of Agoda’s Affiliates responsible for any content or conduct of any accommodation provider or other third party.

  6. You will indemnify, defend, and hold harmless Agoda and Agoda’s Affiliates for and against all claims, losses, damages, costs, or other harm relating to any Special Booking made by you or any transaction, accommodation, or Additional Services relating thereto or any use thereof. You will not make any settlement that may adversely affect the rights or obligations of Agoda without Agoda’s prior written approval. At its sole discretion, Agoda may, upon notice to you, assume exclusive control over the defense against any claim or action.

  7. These ST&Cs supplement, and are in addition to, the Agoda Platform’s Terms of Use available through the relevant link on the Agoda webpage at www.agoda.com (“Terms of Use”) and any other applicable terms or policies. Any capitalized term not defined herein shall have the definition ascribed to such term in the Terms of Use. Agoda’s rights, remedies, claims, and defenses in connection with these ST&Cs and/or the Terms of Use are complementary to the maximum extent possible, and each right, remedy, claim, or defense of Agoda shall not be construed as waiving, limiting, or otherwise adversely affecting any other right, remedy, claim, or defense of Agoda.

  8. Any ambiguity in these ST&Cs shall be construed in accordance with Agoda’s interpretation. If any part of these ST&Cs is found to be invalid or unenforceable, the remainder shall not be affected, and the part found to be invalid or unenforceable shall be replaced with such new valid and enforceable provision having similar effect to the maximum extent possible.

  9. These ST&Cs are made and written in English, and any translation provided shall be for convenience only. If there is any inconsistency between any translation and this English version, this English version shall prevail.
